MOJ Limitation Handler Department: Legal Employment Type: Permanent - Full Time Location: Bolton Description The role is positioned within our Volume Motor Litigation Unit which deals with motor litigation across MOJ, OICP, Portal Limitation, Small Claims and Fast Track claims. The unit is made up of distinct file handler teams managing the different work types previously mentioned. The unit offers clear progression pathways, both technically and operationally allowing candidates to continue their career journey within the business unit. The role of Limitation Handler is positioned within our Portal Limitation team managing a caseload of MOJ and OICP cases that have reached limitation on behalf of key insurer clients. The candidate will be required to follow client instruction, effectively manage Court deadlines and be competent in drafting applications where required. Full training will be provided. The role would suit an experienced MOJ or OICP litigator looking to progress in to more technical portal handling or a small claims litigators seeking to enhance their litigation knowledge in this niche portal PI area. All Claims will be handled on behalf of the Defendant. The candidate should be able to demonstrate a good working understanding of the pre and post litigation CPR and practice directions for portal claims and be able to follow defined strategies to bring claims to a satisfactory resolution in line with client instructions. What will your day look like: Drafting and filing all required Court documents, i.e notice of acting, applications, consent orders. Consideration and management of application for extension of stays. Formulating initial and ongoing Strategy, efficiently and effectively, having in mind the appropriate fee structure Liaising with Insured and Insurers and Brokers where necessary Ensuring ‘actions’ are carried out as per Action Lists in Case Management System Briefing and liaising with Counsel. Adherence to all Court deadlines. Identifying cases with a value >£25k. Identifying large loss triggers. Pro-active control of life cycles. Focus on phone contact. Knowledge and Abilities: Good knowledge and understanding of the MOJ Civil Procedure Rules and associated time scales. Experience of valuing general and special damages utilising a variety of tools including JC Guidelines and case law. Prior dealing in quantum negotiations. Prior experience of drafting documents. Working to set deadlines. Dealing with and managing Claimant Solicitors, policyholders, clients and the Court. Managing a caseload. Excellent listening and verbal communication skills Ability to remain calm under pressure Ability to take constructive feedback and set personal goals for continuous improvement.
